These Terms & Conditions govern your use of pebullion.com and any purchase from or sale to Pony Express Bullion LLC ("Pony Express Bullion," "we," "us," or "our"). Please read them carefully. By using the site or placing an order, you agree to these terms.

Eligibility

You must be at least 18 years old and able to enter into a binding contract to purchase from or sell to us. By transacting, you represent that you meet these requirements and that the information you provide is accurate.

Pricing and market fluctuation

Precious-metals prices move continuously with the live market. Prices shown on the site are indicative until an order is confirmed. When you place an order, the price is locked at the moment your order is confirmed, based on the spot price at that time plus our premium.

Payment

We accept the payment methods shown at checkout, which may include bank wire, ACH/eCheck, and major credit and debit cards. Orders must be paid promptly per the instructions on your confirmation. Orders paid by wire typically ship soonest; other methods may be held until funds clear. We reserve the right to verify funds before shipping.

Cancellation and market loss

If you cancel a confirmed order, fail to pay on time, or a payment is reversed, you are responsible for any market loss — the difference if the metal's market price has fallen below your locked price — in addition to any applicable fees. If the market has moved in our favor, market gain is not credited to you. This mirrors standard practice across the precious-metals industry and reflects the price risk we take on when we confirm your order.

Order acceptance and verification

All orders are subject to acceptance. We may decline, limit, or cancel any order, and may require identity verification consistent with our AML/KYC program before completing a transaction. We may refuse or report any transaction we believe to be unlawful or fraudulent.

Selling to us

When you sell metal to us, a locked price is established at confirmation on the same market basis described above, and the same binding-commitment and verification principles apply. Payment terms and method for purchases we make from you will be provided at the time of the transaction.

Shipping and risk of loss

Shipping and delivery are governed by our Shipping & Delivery Policy. Returns and cancellations are governed by our Returns & Cancellations Policy. Both are incorporated into these terms.

Not investment advice

Information on our site is provided for general purposes only and is not investment, tax, or legal advice. Precious metals carry market risk, and past performance does not guarantee future results. You are responsible for your own purchase and sale decisions.

Limitation of liability

To the fullest extent permitted by law, Pony Express Bullion is not liable for indirect, incidental, or consequential damages arising from your use of the site or any transaction. Our total liability for any claim is limited to the amount you paid for the order giving rise to the claim.

Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Denton County, Texas.

Changes

We may update these terms from time to time. The version in effect at the time of your order applies to that order. The "last updated" date above shows when these terms last changed.
